2007: The Lynn and Erin Compassionate Use Act allowed for the use of medical marijuana.
In 2007, New Mexico’s governor, Bill Richardson, signed a bill legalizing the use of medical marijuana for patients with qualifying conditions.
Can I possess, buy or grow marijuana in New Mexico?
Patients with a qualifying condition and a medical marijuana card can possess six ounces of marijuana at one time. Patients can purchase cannabis from a medical marijuana dispensary and are permitted to grow up to 16 plants after filling out an application for a Personal Production License. Qualifying conditions include but are not limited to: Cancer, Glaucoma, Epilepsy, HIV/AIDS, Ulcerative Colitis and Multiple Sclerosis.
Can I operate a vehicle while under the influence of marijuana in New Mexico?
New Mexico law states that a person should not drive while under the influence of any drug to a degree that prevents them from safely operating the vehicle.
How do I get a medical marijuana card in New Mexico?
In order to obtain a medical marijuana card in New Mexico, you must attain a copy of the medical records containing your diagnosis and a written certification (which may vary based on your condition) from a licensed physician stating that you qualify. You can then register with the New Mexico Department of Health by providing the necessary information and forms.
Can I use marijuana in public in New Mexico?
Patients should not smoke marijuana in a school bus or public vehicle, on school grounds, in their workplace or at a public park, recreational center or other public space.
Can I sell marijuana in New Mexico?
Only licensed medical marijuana dispensaries can sell cannabis in New Mexico.
